Castrol GOAL – Terms and Conditions for Participation

  1. Participation
    1. 1.1. These terms and conditions which govern the participation in Castrol Goal football matches constitute a binding contract between you and Sportsbrand Media Group.        (“Sportsbrand“).
    2. 1.2. You may only participate in Castrol GOAL if you enter into this contract. You are required to obtain parental consent if you are under 18 years of age. Failure to obtain         parental consent as required by Sportsbrand shall give Sportsbrand the option to terminate this contract.
    3. 1.3. Sportsbrand’s tournament rules and rules for games which may be found at www.castrolgoal.com
  2. Registration
    1. 2.1. Registrations may be submitted using the Online Registration Form or any other Sportsbrand -approved Registration Form. You are required to register with a team         comprising a minimum of five and maximum of eight players. All players must individually enter into this contract.
    2. 2.2. Individuals between the ages of 17 and 35 may participate in Castrol GOAL. You may participate in Castrol provided you are at least 17
    3. 2.3. Sportsbrand reserves the right to limit the number of teams participating. Sportsbrand reserves the right to reject any application by terminating this contract at its         discretion.
    4. 2.4. Sportsbrand is not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or         delayed computer/Internet transmissions or other errors or malfunctions of any kind which may prevent receipt by Sportsbrand of a duly completed Registration Form.
    5. 2.5. All teams which are allocated a place will be notified by way of e-mail, phone or mail confirmation.
  3. Participant’s Declarations, Acknowledgements & Obligations
    1. 3.1. You acknowledge that participation in the tournament is at your own risk, and that participation in a football tournament involves inherent risks of accidents and injury,        even if participants comply with the rules of the game.
    2. 3.2. You acknowledge that third parties, particularly those upon whom you have inflicted those injuries by irregular play, could have a claim against you
    3. 3.3. You confirm: (i) you have sufficient liability and health insurance and acknowledge that you have no claim against Sportsbrand in relation to provision of such insurance; (ii) you will not use during participation or bring to the tournament any drugs or impermissible performance enhancing substances or other substances that are      illegal; (iii) you are in a good physical condition to participate in Castrol GOAL; (iv) in the event of qualification for an overseas trip, you are available for such a trip and possess the necessary travel documentation; (v) you will not publish or post on any website or other media operated by Sportsbrand or related to Castrol 5’ any text, statement, photograph, image or other material      which is obscene, blasphemous, defamatory, infringes the intellectual property or other legal rights of any third party or is otherwise unlawful, offensive or      inappropriate. Sportsbrand will have the right to remove any material at its discretion.
    4. 3.4. You warrant that the team name selected or used by you does not infringe the intellectual property of any third party.
    5. 3.5. You acknowledge and allow Sportsbrand to process and use any personal data obtained from you in connection with your participation in Castrol GOAL in accordance         with data protection laws and regulations. Details of Sportsbrand’s Privacy Policy may be viewed at http://www.com
    6. 3.6. Your journeys to and from each event in the tournament shall be entirely at your own risk.
    7. 3.7. Your journeys to and from each event in the tournament shall be entirely at your own cost.
    8. 3.8. You authorise any first aid or medical treatment needed as well as the necessary transport in relation to any such accidents, injuries or illnesses in order to ensure         the  smooth administration of first aid and medical assistance in the event of an emergency. You shall be responsible for the costs of any off-site treatment or         transport.
  4. Prizes & Disqualification
    1. 4.1. Castrol GOAL is organized by Sportsbrand. Sportsbrand will award prizes for the winners. There is no right to claim the cash value of such prizes. Sportsbrand has the        discretion to change the prizes and their composition. Only the prize-winner is entitled to receive such prizes and prizes which attach specifically to a prize winner may        not be transferred to a third party.
    2. 4.2 . Sportsbrand reserves the right to change the time, location or format of Castrol GOAL tournaments and may cancel or limit such events in whole or in part.          Sportsbrand will notify you of any such changes.
    3. 4.3. Sportsbrand reserves the rights to disqualify teams or individual team members from the tournaments or in the course of the tournaments if: (i) individual or all team members provide false information about themselves; (ii) individual or all team members are under 17 years of age and provide false parental consent; (iii) drugs or other impermissible performance enhancing substances or other illegal substances are consumed or offered to a third party by an individual team member or all team members; (iv) team members are not sufficiently fit to participate in such an event without risk; (v) individuals and/or team members breach any of the terms and conditions of this contract; (vi) there are repeated major breaches by an individual team member of by all team members of the tournament rules (www.com) (vii) the functioning of the tournament is adversely affected by the conduct of an individual team member or all team members; (viii) Another important reason exists which necessitates such disqualification.
    4. 4.4. Sportsbrand reserves the right to change the names of teams where the team name in question may infringe or infringes the intellectual property rights of a third party.
    5. 4.5. Football is a team sport. Disqualification may not affect just the individual team member but the entire team. You acknowledge that your whole team could be        disqualified even if your own actions do not constitute grounds for disqualification.
    6. 4.6. You agree to abide by the directions of Sportsbrand, its staff or contractors and to behave appropriately at all times during the tournament.
  5. Advertising & Publicity
    1. 5.1. Sportsbrand intends to publicly celebrate and announce the winners of the tournament. This may be done by way of reports and advertising in all areas of the media         such as film, television, radio, printed publications, Internet, mobile telephone services, announcements and advertising at promotional events. Advertising shall         include but not be limited to advertising for Castrol GOAL, Castrol’s products or trademarks as well as products and trade marks of related and possible partners of         Castrol for the implementation of Castrol GOAL. You accordingly agree to grant Sportsbrand the following rights: (i) You grant Sportsbrand the exclusive, full and unlimited right to use at their discretion your name, your signature and other personal designations and the name of     your team for the purpose of advertising or any media coverage; (ii) You grant Sportsbrand the exclusive, full and unlimited right to produce and make available photographs and / or film recordings and / or sound recordings of you      in the context of Castrol GOAL and any subsequent promotional events, and to use these photographs and / or film recordings and / or sound recordings in their      original and / or modified form in whole or in part for the purpose of advertising or any media coverage including but not limited to cinema, video/DVD, television,      radio, printed publications, and the Internet including but not limited to depiction on website pages, emails and mobile telephone services; and (iii) You grant Sportsbrand upon your agreement exclusive, full and unlimited right to conduct and make available interviews with you in the context of Castrol GOAL       and any subsequent promotional events.
              Sportsbrand is permitted to sublicenses these rights to third parties. The grant to Sportsbrand of “exclusive” rights means that neither you nor a third party may use         these rights.
    2. 5.2 . You shall be available to a reasonable extent for any promotional activities following the end of the tournament.
  6. Liability & Indemnity
    1. 6.1 Sportsbrand shall be liable to you for personal injury or death which is the result of negligence on Sportsbrand’s part. Any other liability on the part of Sportsbrand is        otherwise excluded to the maximum extent permitted by law.
    2. 6.2 You shall indemnify and hold harmless and reimburse Sportsbrand from and for: (i) all losses; and/or (ii) all costs and expenses (including legal costs) that are payable or paid by Sportsbrand to a third party;
    3. 6.3 Caused by you in the context of (i) your participation in Castrol GOAL or as a result of any breach by you of those terms and conditions. (ii) on account of an infringement of that third party’s rights (including but not limited to intellectual property rights, names and , trade marks); caused by the selection       and use of your team name.
  7. General Provisions
    1. 7.1 This contract is governed by and construed in accordance with local law. The courts shall have exclusive jurisdiction to hear any disputes arising in connection with it.
    2. 7.2 If any provision in these terms and conditions, whether in full or in part, is held to be invalid or unenforceable, all other remaining provisions shall continue to be valid and enforceable.
